Sure, anyone can sell short.

They really don't have that many shares coming and they wouldn't be able to convert the last of them for nearly two years (or a little over 1 year of the stock tanks). That's a pretty long time horizon. It's hard to believe they would even buy the convertable if they were that bearish.

Orloff is interesting in that they are the first institution to take a (public) position in FIBR for a long time but they are not major players, remember this was only a $2 million investment.
