Thompson, Dell Slug It Out

The breakup of ad agency J. Walter Thompson and former client Dell Computer is getting nasty. Thompson is suing Dell over what the agency says is the personal-computer maker's refusal to pay Thompson $6.4 million. The suit was filed in New York state Supreme Court. Dell has countersued in Williamson County, Texas. The legal wrangling was first reported this week in Advertising Age. Dell ousted Thompson and switched its ad account to Omnicom Group's BBDO Worldwide earlier this year. In its suit, Thompson says Dell violated a one-year contract that began on Dec. 17, 1997. Thompson says Dell paid the first two quarterly payments but never paid a Sept. 10, 1998 invoice. Of the Thompson complaint, a spokesman for Dell said, "We don't think it has any merit. And in fact, as you will see in our filing, our claim makes the case that what we've received in return from J. Walter Thompson does not match our remuneration to the agency. Our remuneration to the agency exceeds what we received, indeed what we expected to receive in return." Thompson declined to comment.
