Another hypothetical scenario to the lawyers:

A person was very hungry and ate a gallon of VERY cold ice cream. After wards, this person had to be rushed to the hospital as his / her bodies core temperature was lowered by eating all that VERY cold ice cream in a short period of time. This was a potential life threaten condition - Hypothermia.

After a few days in the hospital for the treatment for hypothermia, he / she received a 4000.00 dollar bill for treatment. Not to mention lost wages, pain and sufering from eating that VERY cold ice cream.

Could this person sue the ice cream company and the store for serving ice cream that was too cold.
