John:
If I am not mistaken any (of its own) stock acquired by a company is considered treasury stock. Once stock is authorized and then issued it can not be reissued again unless it is reauthorized. Thus if the buying/selling was handled through privately-held shareholder accounts this would negate having to get the stock reauthorized and of carrying it on the balance sheet of the company. I'm sure that the company (Don) did not plan for the stock to continue to fall in price and expected the "loan" of funds to buy the stock to be a short term arrangement, but in fact it turned out differently.
