My accountant advised that this would not be considered a wash sale because they are not substantially identical. The web site you linked to seems fairly generic in its' definitions and approach. It makes a broad statement without details and so I would be leery using them as a source. The merger is not a done deal. It has not been approved by the stockholders. The stocks do not trade in an identical pattern. They are still 2 different companies with different risks. Joe C.
