WASHINGTON, Dec 16 (Reuters) - The judge presiding over the Microsoft Corp. (Nasdaq:MSFT - news) antitrust
trial said on Wednesday that America Online's proposed acquisition of Netscape Communications may have an
''immediate effect'' on the case.

''It seems the Department of Justice would be in possession of the operative documents (for the merger) and that Microsoft may have a
right to review the terms,'' said District Judge Thomas Penfield Jackson, referring to the merger review process required by law. ''It could
have an immediate effect on the definition of the market.'' Market definition is at the heart of any antitrust case.

This thing is like a racehorse being held back at the gate. I was watching the Level 2 when it broke out - money flow went from about 3 million to 50 million in a matter of minutes. It wants to go much higher, it seems.
