I think there may be some confusion over the term "cap". The 5% franchise fee is meant to reimburse governments for allowing cable operators to use the public rights-of-way to deliver their signal. It is a maximum reimbursement, and many franchises charge only 3% or 4%. In any case, the franchise fee itself has very little to do with how cable companies price their product.
