When is the very last trading day that people living in the U.S.A can sell shares for the purpose of Tax Loss?

Are MM's required to cover any/all short positions at the same deadline time frame as Tax Loss selling to consolidate trades for 1998? In other words are MM's required to start a new year with a clean slate--or are they entitled to carry over short positions from one calendar year to the next.

As I am a Canadian living in Canada to the best of my understanding any tax selling done in Canada must meet the three full settlement days requirement following the day in which a trade was confirmed as being completed.
