With respect to your first question, a Patent is part of IPR, or Intellectual Property Rights. Other "things" that are part of IPR are: Trademarks, Trade Secrets, and "Know-how".

There may be a few others, but those are the major ones.

With respect to your second question, it appears that one side may be right and the other wrong. If Qualcomm and Ericsson "slug" it out in court, both parties will try to invalidate each others patents.
