Yes, it is, even if you expose your position, because you can change that fact after you've made your recommendation. Disclosure doesn't protect you.

It is 100% untrue. Restrictions can be imposed on those with licenses, but those who do not have licenses can't be regulated. Check out the numerous stock newsletters in existence. It is a 1st amendment protection.
