I did see the segment and the focus of the exchange was on WAVO, and yes he did at one point start talking about "fraud-u-net" stocks in the midst of it. He didn't come right out and say WAVO is a "fraud-u-net" stock, but one could quite reasonably walk away with that impression.

As far as his opinions go, I say he's entitled to say whatever he wants, he can call a stock overvalued, a dog, a dog with fleas, or a dog with fleas on the fleas. My point was that using the term "fraud" in his comments is dicey with potential legal liability and I assume that if the company can show that they suffered materially because of it, he could be in a bit of trouble.

My guess is that the CNBC lawyers are going over and over the tape, word for word in an effort to see if there is any potential liability there. Since he was making his remarks as a "guest host", I'm not sure if the network has any potential exposure. I'm sure if their lawyers decide that they're safe, you'll see Cramer back on the air, forthwith.
