I agree with your opinion about the credibility of this "Story".

IMO, however, to be credible at least a couple of possibilities had to occur:

1. The customer had ordered a specific level of BIOS and systems didn't comply.

2. The customer ordered a "customized" BIOS which would be installed after software load.

3. Brother and Husband concocted whole story while ice fishing and drinking cheap brandy.

I lean heavily to the latter.

Without the BIOS you can't do the pre-shipping check or even install software.
The software is most likely blown onto a disk in a completely different system as a whole disk image - these machines do not get systems loaded by the install process you and I are familiar with.

Also all of this talk about libel and legal or financial liabilities is just silly. Such action just calls attention to the original arguments, right or wrong, and is only pursued in a case of malicious and repeated factual errors resulting in demonstrable loss, especially in a forum where first amendment rights can be generally assumed to prevail, such as this one.

I can hardly believe otherwise sensible posters are talking this kind of nonsense. As I said to Frank on the CPQ thread, if DELL actually wasted shareholders' money on such frivolous legal efforts, I would think it is time to short the stock. BTW I am confident that they have a little better perspective on this than that of our more volatile threadsters...
