The Senate procedure is a trial with the Chief Justice presiding the the Senators sitting as jurors.
While the procedure is similar to a trial it is not the same as a trial in the courts. A trial in the courts is subject to the rules of the courts, ultimately the Supreme Court. A Senate procedure, even this one, is subject to the rules of the Senate. The Chief Justice actually has no role except to sit there are look pretty (actually he can cast a tie-breaking vote when necessary). The Chief Justice can make rulings of procedure, but they can be overidden by simple majority vote which means they are only suggestions.

I've got a lot of respect for the wisdom of the founding fathers. Yes, they tried hard to make a United country.
