I have a wash sale question
that I have not found an answer to: Suppose twenty days ago I incur a loss on a day trade (round trip). Suppose I then daytrade the stock again tomorrow and make more than I lost on the earlier transaction. Suppose I then buy it back a third time day after tomorrow and hold it into next year. Given the above, can I deduct the first loss from the gain in the second transaction for 1998 ?

Somebody asked this question on the TDFX forum:

I answered yes, in the spirit of KT's wash sale page (Section Playing Games
fairmark.com
), and pointed him to the page. However, his CPA friend argued that since the merger has not been approved, and since there is the risk of the deal falling thru, they are still 2 different companies as far as wash sale is concerned.

If his CPA friend is right, I have a couple of trading days left to do the same thing to claim a tax loss. Colin and Kaye, can you help?

Can anyone recommend a good book, title and author, which discusses tax strategies?

Specifically, that pertaining to capital gains and daytrading.
