and the unthinkable happens (ie-the stock price increases), then
fair value is higher and xoma becomes "more taxable".
The short answer is (according to the company) this would not have a significant impact unless the stock gets into the teens.(nol's I think)
Also (I think) management can still reverse it should that happen.
(not 100% sure on that though)
So then one must ask>does the company want the stock into the teens right now. Then one must ask if the company could get the stock into the teens. Something to consider pre and post dec 29th.
