FACT: On December 18, 1998 califtalk posted the attached message on the OLEX message board. In this post, inquires are made regarding the fax surrounding a purposed joint venture of Oilex, Inc. and Phoenix Reserves, Inc. (the following is the post made by califtalk (Saul Yarmack) on Dec. 18,1998 ) "the tax returns of Phoenix Reserves, The joint venture, and Allen Burditt and Oilex for 1996 the letter from Gossett & Rushing the 1997 checking account records of Phoenix Reserves that show the joint venture items The testimony of Merdinger, Fruchter,Rosen, & Corso will convince the Judge as to the truth of the fact that Burditt looted Oilex and that a criminal conspiracy existed that was conducted by Allen Burditt and assisted by the negligence of the officers and directors of Oilex, and / or the assistance of certain professional individuals. Also that the BT Energy partnership that was owned by Burditt and Timmins, and kept as a secret from the shareholders and auditors, and was used to make hidden profits at the expense of the Oilex shareholders. This statement by the auditors will trace and identify the transactions and prove to the Court the truth. Burditt will not be able to avoid JUSTICE. " In the above response Mr.Yarmack alleges that , “The testimony of Merdinger, Fruchter,Rosen, & Corso will convince the Judge as to the truth of the fact that Burditt looted Oilex and that a criminal conspiracy existed that was conducted by Allen Burditt and assisted by the negligence of the officers and directors of Oilex, and / or the assistance of certain professional individuals. “ We spoke today with Steve Corso of Merdinger, Fruchter,Rosen, & Corso. He stated that his firms name was used without their knowledge and that the firm has no knowledge of any criminal acts. Mr.Corso also stated that they are not a participant in allegations in wrong doing of Phoenix Reserves, Inc. or any of the individuals listed in the attached response by califtalk (Saul Yarmack).
