Any company of substance would be crazy to sue an individual due to the process of discovery can be very painfull assuming the prospect the individual won't roll over and play dead. Who want's to rattle their skeletons in an attempt to nail a guy. Gotta have him dead to nuts, but even then the cost and downside risk are immense, which is why only stupid people take this course of action. Real companies would rather focus on pertinant business issues.
