Colin and Kaye,

Somebody asked this question on the TDFX forum:

- Now that TDFX and STBI have announced their merger, if I
sell my TDFX shares and immediately buy STBI, would that constitute
a wash sale?

I answered yes, in the spirit of KT's wash sale page (Section Playing Games
fairmark.com
), and pointed him to the page. However, his CPA friend argued that since the merger has not been approved, and since there is the risk of the deal falling thru, they are still 2 different companies as far as wash sale is concerned.

If his CPA friend is right, I have a couple of trading days left to do the same thing to claim a tax loss. Colin and Kaye, can you help?
