why would they not stay silent while trial goes on? Why call attn to their success

In the past year, they did not want to stand out among hi tech companies that were having problems or forecasting future difficulties. Now things look pretty good for the other companies in this field. If they don't draw attention to their success, they risk being considered to be on their way down in this new technological environment. This sort of public perception could actually push sales down -- because people want to be associated with the best and latest.
Look at the AOL move (this is a big ISP with a portal site!!!). This company is in a very competitive environment. They face competition from MSFT, Phone, Cable, other ISPs and portals. I am waiting to hear about alliances or mergers among these other providers to make themselves bigger. It does not make sense for the MSFT stock to be this "low" when you see AOL, anther dominant company, soaring to new heights. Sooner or later people will realize it.

MSFT would not look out of place if they publicize their success in todays environment. They want to have the public perceive them to be the best tech company out there in terms of share price and products because they need to attract the brightest minds in the industry --- A sideways move of the stock won't help them in this regard as prospective employees (the brilliant ones) may choose another company which would give them options making them richer (faster).

BTW -- Dell rocketted in the last 2 years for two reasons
1)a great business which they executed perfectly
2)the public's perception of this company as a winner -- which in turn drives sales --which then pushes the stock up ---which in turn drives sales ..........on and on.
