John, all I'm saying is that it is a non-issue. There are sufficient shares to complete the deal. Treasury shares are irrelevant. If AOL needs to issue around 47 MM shares it has sufficient unissued shares for that purpose.

BTW, a company never "holds" its own shares. When it repurchases shares they are "retired" to treasury. That does not mean they are cancelled, and that has no effect on the number of share authorized. It simply decreases the number of shares issued.

Bob Pittman on CNBC tonight at 7 PM. They were just talking about ti and it was the first time that CNBC has sounded positive on AOL in weeks!
