The criminal indictments are public info...so it can be argued that they are priced into the stock.

The perception may be that Hsu and cronies will get off with a slap on the wrist. Or investors may believe that Hsu ouster may be a GOOD thing!

What is more important is that Judge Whyte has urged both parties to settle. This would be a *good* thing for AVNT since any such settlement process would mean CDN would probably cool off.

My original premise for shorting AVNT was that its potential liabilities were so massive that the company could be erased overnight. The criminal proceedings were just icing on the cake.

Since the liability question is no longer clear - I would advise against shorting AVNT at this point. I still think that Hsu and company are dirtbags - but that won't have much bearing on the stock price now.
