Mike you should conduct some DD and get truthful answers to the reasons for the Lawsuits I think it's important, dont you ? After all it's public money that's being used to pay for all this Legal wrangling in the Courts , Money that would be better served by paying for drill programs etc.
Perhaps the Company Hierarchy should turn to negotiation rather than confrontation in the Courts , it's far cheaper and would probably be just as effective if not more.

Mike, found using SEDAR...I wonder who owns these debentures and don't you think they will want to recoup this somehow????? Please notice the word: unsecured

Dayton Mining Corporation (the "Company") has entered into a commitment letter under which an underwriting group led by Nesbitt Burns Inc., and including ScotiaMcLeod Inc. and CIBC Wood Gundy Securities Inc., have agreed to underwrite the purchase of unsecured convertible debentures in the aggregate principal amount of US$60,000,000, which amount may be increased to US$69,000,000 through an underwriters' option.
