It lets the market makers hide behind the nasdaq order handling rules which state they have discretion in how quickly they post client orders after halts,IPO's, and at the open. In other words they have "carte blanche" to do what they always do ...make money on a big wide spread while screwing the little guy at the big national firms who sell their order flow to the market makers.
