The $600,000 settlement with BWAI shareholders was clearly disclosed in one of the quarterly filings. (Sorry, but I honestly can't remember the dates and I just don't feel like going to look for it.) The settlement from the ex-officers was mentioned in a CC when somebody asked where they had gotten the money to redeem $700,000 of the preferrerds. They said the money was from this settlement and the repayment of part of a loan by ABCN. (As a side note because of the suit filed by Castle Creek to try to prevent this redemption, Orloff was issued slightly more shares than CCI originally held, so the net result of all was was only a slight reduction in the outstanding preferreds.)

David is not misrepresenting the facts concerning this.
I think most of us look at the $600K settlement and the $325K repayment as separate issues because they happened several weeks apart and I think they were "on the books" in different quarters. We don't question it because we remember when it happened. The $600K to BWAI was old news and none of us were expecting any repayment, so while the $600K was a bummer, from our point of view the (partial) repayment clearly was a victory. I knew he was taking about the repayment not the settlement and I just assumed everybody else did too. This was a good question though and maybe us longs should be slightly embarrassed that we didn't ask it.

If I misrepresented facts, it was purely not inteneded unlike some posts that get put on here. There is a link for the claim that they collected 300k from former executives. It was an SEC filing I found on companyslueth. I did not give any wrong facts, I just didnt include they paid 600k to shareholders, becuase I didn't see or know about that, just as you did not know anything about the 300k osicom got from the former BH execs. Please do not imply I misrepresent the facts.
