Mad, it was in fact Datek I was able to execute the short on Ebay with. I recall they put the NS on it around 90. Before then it was on again, off again.

As for the margin-cash situation you and Barb could be correct as I have never checked on my cash account. I use a margin enabled Datek account to short with but always use cash.

My tactic is to put my Datek account into a shorting position by paying off the margin through appreciation of "NM" stocks. When I achieve a large enough position in cash I pick a short equal to 1/2 the value of cash dedicated for that short and put in a 2x stop limit gtc order to protect the other positions.

In this way I am able to speculate both ends of the volatility within the market. It's a brutal tactic but it works for me.

I hope this explains things.

BTW, Ebay wasn't "NM" at the time of the short but I see Datek has become quite active lately in slapping "NM" and "NS" on 'speculative' stocks. Prudent.
