Here Irish is a copy of correspondence I had with XYBR regarding the licensing by IBM of XYBR patents. (Note: I've removed my email address and that of Ms. Macken's).

The text as follows:

From: Monique Macken
To: "'MSB'"
Subject: RE: Answers to your questions.
Date: Wed, 25 Nov 1998 14:54:12 -0500

Dear MSB,

The information that I give you is public, so you have my permission to post it.

With regards to your questions about IBM. Under SEC rules, I am not at
liberty to discuss anything that has not been made public first. We
have not put out a press release about a liscencing agreement with IBM.

To find all the press releases that have been put out, go to the
following website:

hoovers.com

It will be easy to pick out the IBM press releases.

Sincerely,
Monique Macken

Thank you Ms. Macken for your quick response. I feel I've kept abreast of XYBR pretty much, but I'm still a little in the dark about the patents XYBR has and how much of IBM's wearable product is licensed from XYBR. I guess what I'd like to know is whether or not IBM is paying a licensing fee to XYBR for its technology. Perhaps it would be helpful if you could tell me the date of the news release so I can go back and search for it in the news release archives.

Also, may I have permission to post your responses on the Silicon
Investor stock talk board?

Thanks for the response. I promise, I'm not going to be a pest. :-)

Thanks again and hope you'll have a safe and happy Thanksgiving Day as
well.

All the best,

MSB

The above suggests to me that XYBR has not let out any information regarding whether or not IBM has licensed any of XYBR's technology.
