Zebra,

Any good attorney will use that same report focusing on the parts you highlighted. The defense:

My client had a heart attack and almost died because Pfizer did not conduct adequate clinical trials on men with CVD. Pfizer claimed that Viagra with the exception of men on nitrates. After over 200 deaths and uncounted numbers of coronaries Pfizer continues to claim that the act of sex and not Viagra is responsible for the adverse effects noted even after others have pointed out the disporportionate number of coronaries in men on Viagra when compared to other ED treatments such as Vivus' MUSE.

At this time Pfizer continues to deny responsibility for inadequate safety research on CVD patients and only recently admitted that they did not adequately study this important group.

In fact in Pfizer's own unpublished clinical trials only 23% of the men were over 65.

We are seeking damages for our client in the amount of $10,000,000.00

If but one case wins in court and the plaintiff receives only $1,000,000.00 it will set a precident for future cases. If every heart attack plaintiff averages $1M Pfizer have to pay over $1Billion in judgements if only 1000 legitimate heart attack cases sue for damages.

I still see an eventual class act. IMO there will soon be too many cases filed in court not to turn this into a class act. IMO soon enough this will be another Dow Corning type of situation.
