I just got a tentative commitment from a broker who will let us vote his shares if Leland doesn't deliver by the conference call. I won't count it yet but it is close to a million shares.

I just got off the horn with a friend who knows a lot about public companies. His father is a lawyer in the securities industry and will check on some rules regarding publicly traded companies. So far I have this:

According to him we can vote whoever we agree to have on the Vivus board by simply writing in that persons name on the proxy come the annual share holders meeting. If for example Vivus' places all its old board members on the proxy for a vote then we as organized share holders can write in the names of people who are willing to sit on the board(I am shooting for attempting to recruit someone from Astra, JNJ and if the domestic partner is a different company then that would be 3 new people to recruit. I also think it would be a good idea to get someone who is an individual investor in Vivus who could be a go between to the share holders. I asked NF a long time ago if Vivus could have a live weekly Q&A session on the Vivus web page for share holders--the idea was declined.) and vote for them instead of the old board members. Actually even if we are able to get 2 or 3 people from these drug companies the remainder of the 2 or 3 board seats should be filled with individuals who have 1/2 a brain and are heavily invested in Vivus stock(certainly their decisions will be "share holder friendly"). By having at least 4 out of the 7 board member positions under our control, we can then have those board members look for an effective CEO who would replace LW. This is how I tentatively understand the process for change. I'll keep all posted as I learn more info.
