T: An interesting idea, but although Congress has adjusted the legal landscape in the fashion you describe I cannot help but think of that 'ol adage, "Once bitten, twice shy." And when it comes to being a victim......eh......litigant(heh), this be particularly true, hence(in my view) L.D.'s reticence.

Now let's see how today goes...

I beleive the last 10k states that the old shareholder lawsuit, which was won by Valence (with prejudice) but is still on appeal. This lawsuit plagued Lev as well as the other directors (Berg and Shugart) and they were all and possibly still are personally vulnerable. Any one know the appeals' status. I beleive the venue is San Jose California but not positive. State or Fed court? I'm not sure. Anyone know how to check this. It could provide a key to Lev's (and Bergs and Shugarts') reluctance to give progress updates

It is probably Lev's atty's view that counts most right now. He is paid to keep Lev out of trouble, so don't expect a change in policy about releasing information, IMO
I believe there is more than enough information out there to support my long position now. There are sufficient questions to make it a gamble - that's why we stand to make a lot of $.
If it makes someone nervous or drives them nuts - they should get an index mutual fund.
