The timing of the deal relative to the April LMDS re-auction is of interest as sometime soon entries into re-auction is required and then
or soon thereafter anti-collusion rules would have taken hold. So as
prior posts have indicated the extra pay to the FCC probably takes
care of this merger, the FCC will likely lose out in re-auction as one
more player is removed from sometimes avoided competitive bidding. But remember the mandate of Congress is not strictly to receive revenue for spectrum and today's deal may cause some of the runt
remnant markets to attract new bids from new entries.
