There was a dispute over whether the contract amounted to a revenue bearing contract. The second phase had to do with closes above $2, but we can't get to that ,even if it happens, b/c of the disagreement over the nature of the contract.

Obviously, if the stock does not meet the price requirement then he will stipulate to the contract b/c it won't matter. If the stock does meet the price requirement then he will argue that the contract does not meet the requirement. And the longer we disagreed the more time he had to figure out which way to jump. So it is off.

But he is a bright guy and seems to be a serious market student. His attitude on DGIV seems to be that since most of these little companies don't make it, then the percentage bet is to be a naysayer.IMHO. He is really in a "show me" mode, which is not unreasonable.

You and I have much bigger fish to fry.
