Bluegrass, you are correct, I can't explain the situation so everyone understands it. Nor do I see anything that wrong in the approach. Remember no one thought there would be a lot of accruals. Going with deaths is like saying even if you accrue a number of subjects that normally would not permit us to pass judgment on your drug we will pass judgement on it when mortality reaches X even though accruals still have not reached a significant level. This could speed rather than delay a decision.

At any rate, I don't even see the skating on thin ice. Plans and goals slip, and one does not end up in court because everything does not go according to plan.

BTW from your post you owned XOMA prior to the trials and after it became apparent that they would be continued. How can you seriously say you would not have invested in XOMA if the trial had been planned as a 3 year trial?

Good grief. No one's talking legal remedies here. I simply embarked on a routine inquiry: what is the source of this new realization/speculation that total deaths will toll the P-3 and is it some general Xoma news release or private information shuffled along to Murphy or others? I thought it would be a quick matter but it's turning into an odyssey.

I can take a hint. It just takes me longer than most. Sure hope Grandma, the one moving to Bermuda, is feeling chipper.
