Hi Steve:

Actually, the main problem with Baker Creek is that it did not
disclose its HYPT affiliation to the FCC. If I remember correctly,
Baker Creek was turned in by a competitor. So, technically, the FCC
could have penalized it severely, say by yanking all its
licenses.

Nextband did not do anything wrong-- its Nextlink affiliation was
properly disclosed. Nextlink is not an incumbent telco or cable
carrier, so that it had every right to participate in the auction
either directly or through an affiliate.
