".... a) a judge can issue a summary judgment when no motion has been filed asking for one...." you better get a copy of the DEFAULT jeffy boy, it was entered 13 jan. & it clearly shows that "said defendants has failed to plead or otherwise defend in said action as required by said Summons and provided by the federal rules of civil procedure" "the above entitled action is hereby entered January 13, 1999" "....b)in the .00001% chance AZNT filed a motion for one, how a judge can possibly issue a judgment on a defendant that hasn't even had their day in court....." jeffy while you are retaining lawyer to defend yourself ask him about this stuff besides. summons was issued on 17 nov.. , as of 18 dec the defendants were in default. since none of the defendants now in default responded to the summons or have pleaded ant cause or disputed any material issues (there "day in court") a DEFAULT was entered 13 january. since the DEFAULT was entered & served, there has still been no response from the defendants. jeffy boy the defendants have chosen not to defend themselfs, have no legal representation, & have disputed none of the materials issues, nor pleaded any cause upon service of the defaults. ".......c) in the .000000000000000001% chance the judge risks disbarrment and issues a summary judgment in AZNT's favor, if there's a federal marshall in the world who will enforce an action that surely will be on appeal in a heartbeat?....." i believe your point 'c' is only worth addressing to inasmuch it will be good for the defamation suit. at the hearing, if not before , the issue will be lifting the freeze since the stock has already been cancelled. aznt moves to get the freeze lifted so the cancelled stock is out of the system &the the complex web of dtc credits & debits. the judge is to sign the summary judgement on or before 1/29. this will allow federal marshalls to seize the cancelled stock & remove it from the system. aznt will also ask for immediate injunctive relief concerning the dtc freeze. they case will not be allowed to be continued if granted & hopefully the matter resolved. jeffy , in the ".0000000001 %" chance you have 2 functioning brain cells, program them to assist you in retaining good attorney , or in the very leat, cancel your internet service. you are really doing yourself alot of harm. i am through with you for now. be wise & heed my advice. spider
