We have no choice but to believe that before making his announcement last evening, JT had discussions with Soros, Fidelity and Wisconsin. He had to have had their assurances that they would not jump ship if he made it.

Secondly, he would have had to have had the commitment from his lenders that they would not abandon him or call his obligations.

Had he not been so positioned, he would have had no choice but to accept any offer that was on the table. Now this presumes an offer was there but it is inconceivable that after their own DD, any of the three parties listed above would have taken and maintained their positions over the months. We also found out yesterday that Fidelity had added significantly to their holdings during the negotiations period.

Additionally, it is obvious that without supplemental infusions of cash, this business can not survive in its current state. These matters had better have been addressed before the announcement that he was going to go it alone.

I feel that what we are looking at is a perfect scenario for the entry of a white knight or a "surprise" hostile takeover. This theory is based upon a lot of wishful thinking and nothing else at this point but it is helping me get through Saturday.
