I think you make some excellent points. Yes, there should be a level playing field. My guess is that the SEC's using 17(b) to go after people it feels may be hyping penny stocks outrageously. As you know, there are a helluva lotta of 'em out there. I suppose they think that since much more information is available about issues traded on the NYSE and Nasdaq national market that less vigilance is required, but again, that isn't fair.

I agree also that insisting on disclosure of the precise amount of payment doesn't make a great deal of sense. Neither, though, do I feel that a "blanket statement" of the kind used by many promoters--"We may or may not hold a position in this stock; we may receive payment for..."--is sufficient. It would, for me, at least, be enough for them to acknowledge that they're being paid to do what is essentially PR for the company in question.

they should also go after: Research Magazine, Registered Representative, Buyside, Wall Street Transcript, On Wall Street, etc. MSNBC, Investors Business Daily, CNBC ......ALL of them have VIOLATED 17b on MULTIPLE occasions withe the last 12 months.

WHY is the SEC not prosecuting them??????
