The principal point of distinction in this case is the non-exclusive character of the source of VLNC's intellectual property. The Bellcore technology was acquired by many licensees, including large deep-pocketed orgnizations with excellent records of execution in developing and bringing new products to market. In sum, there was not only a clear understanding of the need and demand for better batteries but also the documented wide spread (11 licensees) participation in the development of lith poly source technology. Now we know that at least one of the deep-pocketed firms, Matsushita (Panasonic brand) is bringing lith poly to market. Because of the particular circumstances attendant to this case, it comes as no surprise. Hence the conclusion that there is unlikely little blindsiding in this case.
