Shorting against the box an boxing a short are two entirely different things

Shorting against the box is when you hold restricted shares or warrants and short against shares you will one day recieve. This is common amongst PR companies that get paid in restricted stock.

Shorting 101 is now dismissed

And if you meant a short one in the box, I've NEVER had that problem. ;-)

Robb, there is a deferral mechanism available. I believe you must expose the position before January 31 and leave it exposed for at least 60 days. One used to be able to box a position and never pay taxes on it without risk. Those days are over.

BTW, I'm not a tax pro, and don't mean for this post to be taken as tax advice, just my understanding of the current law.
