Could you explain "art" and "claim construction" to those of us without a J.D. or Esq. after their name?

I think the Lexar suit is very important, that it is a test case and that it may force other card assemblers (PNY, Viking, Eiger, Microtech, Simple Technology) to ante up. I posted earlier (last year) that these guys pay for the raw silicon (Hitachi) included in the "chip set" and do their own CF card assembly. They think that paying a royalty to Hitachi eliminates the need to observe any other flash memory patents involved in manufacturing.

I believe that SNDK chose to pursue Lexar because they had a strong case. You need not pursue each company individually, just establish a precedent and then apply gentle pressure.
