Actually the BID was at 3 as of 9:25. IMO the market manipulators will play with Vivus looking to see how many weak hands they can shake out early this morning by bidding the stock down and waiting to see how low they can push it until the buying comes in. Don't forget they still have well over 6 million shares that they need to cover. No doubt this is a war of attrition.
