It may well be. We have to wait and see when judges start ruling against software makers. IMHO it was reasonable not to expect a piece of code written in 1975 to be in use 25 years later, considering the rapid pace of progress in computer technology.

On the other hand any software shop that produced non-Y2K compliant software in the last year or two deserves to be sued into Chapter 11.
