Hi Klaas,

I don't feel that this slight up tick has anything to do with an early settlement with the Kazaks as they have until the middle of February to file their defence in court. The upward movement in the price is more based on the fact that there isn't much stock for sale. The heavy selling we witnessed at the end of the year was for tax loss reasons and being at the start of a new year and with no tax loss advantage to sell whoever didn't take advantage on the fire sale will be forced to bid the stock up. Interesting to see Geopel/McDermid is coming back in on the buy side they have been pretty quiet lately. Also the volume hasn't been there and if we were close to a settlement or win in court I would expect to see a strong move to the upside and extremely heavy volume. There are a lot of people/institutions watching and waiting to see what happens and if the ruling is in our favour they are jumping in feet first. MHO is we'll win one way or the other!!! Good Luck.

Regards,

RAK
