Sun,

The emulator requires you to copy the ROM onto the hard drive using a special disk drive hook-up. I suspect 99% of emulator use will probably be in the form of copied/pirated N64 ROMs.

Also if the two programmers made the emulator using the N64 source code and didn't full reverse engineer it, that is another legal problem.
