john, In my personal opinion, this claim has merit, especially from an ethical and common law perspective. The flip side is that winning this claim would be like trying to legislate that only the missionary position can be practised by prostitutes. There is nothing new in the statement of claim. These sort of practises are the norm on the VSE. It is common knowledge that when you frequent a whorehouse, you should expect to pay and get f#*ked. Promoters MUST have extremely deep pockets and outstanding promotional talents to discourage this type of brokerage activity, otherwise, the junior and its capital and its shareholders money are just grist for the VSE mill. I am not aware of any similar prior suites like this one. If they win, it will revolutionize the junior equity markets. You can be sure that every member of the VSE will be contributing to the defense fund on this one. Members of the VSE have made their fortunes and continue to do so by having a constant stream of small players come and sit at their "open stakes poker game" and play by their rules.
