I have tentatively decided that IMO it would be prudent to perhaps not charge forward into getting rid of Wilson but at least to form a discussion thread to determine exactly what the share holders rights are and exactly how we would go about attempting to hire on a new CEO. The next annual share holder's meeting isn't until the end of May. This still gives Wilson plenty of time to wrap up a deal and it also gives us plenty of time to organize and educate ourselves as to how we would go about forcing the issue.

Perhaps we should start a new thread on Vivus tentatively organizing and exchanging information/ideas as to how we would implement such a movement? This would at least give the share holders a feeling that we are at least doing something to protect our interests concerning the value of our Vivus shares.

Leland Wilson has now had exactly 7 months to negotiate his partnership deal. I can understand reasons for delays but we must draw a line somewhere.

I am going to draw the line as the end of this quarter. If he has nothing to offer us by the next conference call then I believe he should be relieved of his duties. We have all been very frustrated yet very patient concerning this matter. We know that the partnership deal is the largest factor that can rapidly make our Vivus shares become worth a lot more than the current sub $3.00 level.

Wilson can only hold out for so long. If he never gets what he deems as the "right" deal he is just simply going to have to settle for less. If the potential partners are all set on taking advantage of Wilson's weak negotiating position then sooner or later he is going to have to accept one of the present offers even if it is less than idea.

Wilson has claimed that Vivus' negotiating position has been strengthened over the past 6 months as Viagra safety concerns have continued to gain momentum and as Astra and Janssen has proved that MUSE can sell well in a Viagra market if it is marketed properly.

At this point in time we have to accept his statement at face value.

For all we know, the FDA could announce a black boxing of Viagra next week. Come mid February, we should get another quarterly update on the Viagra body count. Perhaps with this announcement the FDA will announce that they have required Pfizer to black box Viagra to warn physicians not to use the drug in men with cardiovascular disorders.
I feel that this is going to eventually happen but since it appears to me that the FDA has been in bed with Pfizer since the get go, it is going to take some time for science to prevail over politics.
