These patents have never been tested in court, as far as I know. It seems to me if you can clone a Pentium II chip, you can clone just about anything. ACTV's best shot is to get these damn chips out there and start making money now before people start challenging their patents in court.

On the whole we have been pretty low key about our intellectual properties. IMHO, there is a method to the madness. We have not even started to play our hand in this game. The future of total digital communication is in it's infancy, a new industry will be formed when the TCI/ATT merger takes place. If I were Bill Samuals, I would keep my cards close to the vest until I proved the product out in the market place, then I would promote the patents one at a time to derive the maximum value out of them. As for rapid growth, I'll take a 1/4 point at a time until we roll out. I am in this for the long term growth potential, not the short term trade.

We do need better PR at this point. We need an on going, constant news stream out of the company about our EARNING POTENTAL. We have got to put numbers to these services. Not the same general news releases about what we are planing to do and who our partners are, with one month gaps in between. LONG TERM INVESTORS, not speculators or day traders make the real value in the market. INVESTORS want to know where the earning potential is coming from. This whole digital industry is about to become very hot, maybe even hotter than the internet plays. IMO, it is important that we are a known entity and have some what of a higher profile than we do now, to position ourselves to make the move that I think management is counting on.

U.S. Likely To Approve AT&T, TCI Deal Soon

WASHINGTON (Reuters) - The Federal Communications Commission is expected to approve within two weeks AT&T Corp.'s $48 billion purchase of cable giant Tele-Communications Inc., after the agency's staff recently backed the merger, sources familiar with the staff report said Tuesday.

The staff recommendation, which will be voted on by the agency's five commissioners, did not suggest that AT&T and TCI be required to grant open access to their new high-speed Internet service to competitors, as some Internet companies had advocated, the sources said.
