Thomas, you know more about this than I. I was speaking generally. The assumption being you CONTRIBUTED IBM to the partnership and that IBM was HELD by the partnership. Should the partnership SELL the stock, that, of course, has tax ramifications.

If there was no rule against this, people would simply form partnerships and sell their stocks from within thereby distributing the taxable gains among the partners, who are in lower tax brackets.

Perhaps that's what you are referring to???
