I don't think that Christine can feel comfortable with such a system. I certainly don't. In fact, I question whether one can justify capital punishment even for the guilty: Does the state have the right to break its own laws?

Yes, actually I can if the common good is being served. American citizens have their greatest right ripped away from them every day by other, more violent Americans, so obviously it is not a perfect world (unless you own a black helicopter)! ;^)

If all murderers were handled fairly and equally, an argument can be made that it serves the interests of the state. I guess I would also note that DNA technology will help us make more accurate determinations of guilt and innocence. I certainly don't support enforcing the death penalty under the current circumstances, where poor people of color are executed in far greater numbers than more affluent white people who commit the same crimes.
