it's really simple. The fine print is to protect them from you getting a strong position legally if they screw up. The diff is that a screw up is not with intent. Withholding material info that would perhaps make you change your mind about doing business with them, is with intent. If they take your money, and cause you losses, and knew before they took the money that it was likely to happen, because they can not handle the load, they are in deep sewage.

Forget class action......go it alone.
