Tha actual sale can be beyond the last_1 (consider last is buy at the ask). The bid you hit must be "green" or you split the market and get a fill.

Michael, actually I checked just for you. I had my quote program open so it was no big deal.

Nasdaq stocks are on a bid uptick only. As long as the best inside bid is higher than the previous inside bid, short sales are legal. Also, you may sell short if you offer your shares 1/16 above the best inside bid.
